Our 5th anniversary is coming up at the end of May. She had mentioned before about adding to the arsenal and she's always wanted a Beretta M9 variant. I know I'm in a different state than most of you (pa), but have any of you guys bought someone a pistol as a gift? She's legal to own one and has a few others in her name but I just wasn't sure what the process was. I plan on stopping by the shop this week but figured I'd see what ya'll knew too.

Straw purchase in pa is a big no no! As with most states but I know for sure it's frowned upon heavily there. I'm usually in Grice gun shop In Clearfield once a yr and it greatly pains me not to be able to purchase there being an NC resident. I can carry concealed in PA but can't purchase a handgun? WTF! Maybe you could buy her a gift certificate and she'll understand? Nothing says happy birthday with a bang better than a gun!

Seems to me that the only way to avoid it being a straw purchase would be for me to buy it, registered in my name, and then transfer it to her. To my knowledge, she's never even fired a Beretta so maybe I'll just take her to the shop and rent one. If she likes it then it's just a quick trip to the other side of the store to purchase.

That's like a straw purchase in ga being illeagel to do with a car for someone. **** happens everyday. Just don't run around screaming "hey I did a straw purchase". ;D
I don't get that at all. They say no straw purchasing, but yet after it is purchased it can go through whoever's hands has enough money to buy it. Horseshit

Lol. Cars would be one thing. And I've never been accused of not taking enough chances but when it comes to firearms I like to stay on the good side of the law.

Obviously each state has its own set of details in the law. I have never thought of or known of gifting being considered a straw purchase on any level. There is a substantial difference in "hey I bought this car for you, I hope you enjoy it" and "hey, here is $2000 will you buy that car for me".

I don't keep up with it like I used too, but unless the laws have changed you can legally buy and give one as a gift as long as the person you give it to can legally own one. that being said most ffls will get stupid if you mention it

And that's how it should be!

Besides, if the op is buying a gun for his wife, what would it matter if the gun was "hers" or "his".

Same with cars. Or anything else you own when you are married.

I bought my wife gun for Christmas and it never crossed my mind that I was doing anything less than legal.

Speaking of cars, my DD (the taco in my avatar) is my wife's (registered to her, she owned it before we were married) and her new 4Runner is in my name...

That's true. The only reason, although not a very good one, for having it in her name is so I don't get accused of buying it for myself. Lol. But she knows I've never had much of an interest in berettas so hopefully that's not an issue. The other thing is we don't have seperate accounts so in the end, it'll still be paid for by both of us and get put in the same safe.

I don't know exactly what paperwork we use each year, but our Volunteer Fire Department has a raffle each year for a long gun of some type, [I know a handgun may be different], but we purchase the gun before hand and then whoever wins it goes to the shop we bought it at and has to register it in there name. I don't know if it's registered to someone in the vfd when it's bought the first time, [I don't think it is] I would ask of there is some kind of paperwork so she can go back and get it put in her name without having to register it twice and pay twice. I'm sure you're not the first spouse to buy one as a gift, a decent size shop has probably done it before.

Just ask the guys at the shop you are looking to buy from. I wouldn't anticipate any issues buying a gun for your spouse unless you know they aren't legally allowed to own a gun as was mentioned before.

In a northern state it might be different, but your local gun shop should be able to steer you in the right direction.

One good thing we have going on here and may be the same in other states is that long guns needn't any paperwork when sold privately to residents. I can go to a gun show, flash the guy my license, hand him cash and walk away with a rifle. Perfectly legal, no questions asked.

I'm going to swing by the shop this week and see what they have to say. I have a feeling though that it will just end up in my name.

I live in the great state of Kansas where freedom still rings!

Like someone else mentioned its only a straw purchase if said person gives you money to by something on their behalf. I you purchase something without telling said person it becomes a gift and you can legally gift a firearm to someone in your resident state, as long as they are legally allowed to own said firearm.
Here in Florida I can legally purchase a firearm for anyone as a gift as long as they can legally own one and they don't contribute to the purchase.
