The judge asked if I had been served papers, Dale said "not yet, we just filed an hour and a half ago"
So the judge held it over for one month for me to be served with those papers.
I was served and all that was listed was Dale and his wife.
I had the bankruptsy court this morning in which in fact it was just him and his wife.
Even his wife and his lawyer said I could still go after the company
So today at Court, I went in expecting for the judge to say " IN the case of Dale D, there is nothing I can do.. we will hold a continuance to see if Mrs K would like to further this with other companies"
But he said "ok I see no reason why we can't move forward with this with the other companies" Then he asked if James (area manager) saw any reason why we couldn't. He said " I guess not"
So we heard the case and James lied his ass off in every possible way he could. Biggest thing was claiming they had no way of proving that my 3rd member at S&N was mine.
The judge basically said "well it came to your shop with oil on it that shouldn't have been where it was and I see no reason why that 3rd member wouldn't have been hers, So I'm going to award in her favor":cheer: :cheer: :cheer:
I'm not going to advertise what we were awarded as we have enough problems right now with the truck etc..
But I will say it was at least the amount I asked for for the parts and labor.
It wasn't the full amount I asked for, but I'm happy.
