I accidentally turned a pair of jeans into jorts one time after an untimely scissor jog. Totally uncool.

Driving under the influence. (Effective July 1, 2007.)

</B>(1) A person is guilty of driving while under the influence of intoxicating liquor or any drug if the person drives a vehicle within this state:

(a) And the person has, within two hours after driving, an alcohol concentration of 0.08 or higher as shown by analysis of the person's breath or blood made under RCW 46.61.506; or

(b) While the person is under the influence of or affected by intoxicating liquor or any drug; or

(c) While the person is under the combined influence of or affected by intoxicating liquor and any drug.

(2) The fact that a person charged with a violation of this section is or has been entitled to use a drug under the laws of this state shall not constitute a defense against a charge of violating this section.

(3) It is an affirmative defense to a violation of subsection (1)(a) of this section which the defendant must prove by a preponderance of the evidence that the defendant consumed a sufficient quantity of alcohol after the time of driving and before the administration of an analysis of the person's breath or blood to cause the defendant's alcohol concentration to be 0.08 or more within two hours after driving. The court shall not admit evidence of this defense unless the defendant notifies the prosecution prior to the omnibus or pretrial hearing in the case of the defendant's intent to assert the affirmative defense.

(4) Analyses of blood or breath samples obtained more than two hours after the alleged driving may be used as evidence that within two hours of the alleged driving, a person had an alcohol concentration of 0.08 or more in violation of subsection (1)(a) of this section, and in any case in which the analysis shows an alcohol concentration above 0.00 may be used as evidence that a person was under the influence of or affected by intoxicating liquor or any drug in violation of subsection (1)(b) or (c) of this section.

(5) Except as provided in subsection (6) of this section, a violation of this section is a gross misdemeanor.

(6) It is a class C felony punishable under chapter 9.94A RCW, or chapter 13.40 RCW if the person is a juvenile, if: (a) The person has four or more prior offenses within ten years as defined in RCW 46.61.5055; or (b) the person has ever previously been convicted of vehicular homicide while under the influence of intoxicating liquor or any drug, RCW 46.61.520(1)(a), or vehicular assault while under the influence of intoxicating liquor or any drug, RCW 46.61.522(1)(b).

I'd like to hear everyone's feelings. Now let me preface by saying this topic is limited within the following parameters:


1) At no time is any driving done on a road. Only trail (low range).
2) No driving when sloppy/stumbly drunk. Just talkin about buzz after some beers.


I know many people on here will say absolutely categorically NO. I also know many people who enjoy cracking open a beer on the trail or going on an easy night run after dinner/campfire/beer and before bed. I've wheeled with both types and done both in my lifetime.

I'm hoping this thread doesn't turn into a poo throwing contest :; I'd just like to hear different peoples opinions on why they feel they way they do.


Why are you completely opposed or why do you feel it's ok?

I openly admit, that I stop off in Elbe Wa at the little gas station to fill up and grab a few tall boys. *(Beer) before heading up to Elbe Hills ORV.

I don't tend to drink and wheel on any trail system out there, but when ever I go to Elbe, it's sort of become a ritual... I will have a nice cold 24ounce Beer ready to crack open before I even head down into the BusyWild Trail. and a back up just in case! normally / generally - I will run into someone stuck on that trail, or someone with me will become stuck.

it really helps to break the tension, last time out... someone was so pissy and losing control, they lashed out at me... if I wasn't / hadn't been drinking, I would of most likely got into a fight! but was able to keep my cool thx, to a Healthy Buzz i had going... while watching people pull their hair out and ***** and moan.

of course, 3 days later - it was as if I turned boy's into Men.

yeah... the BusyWild is a little different, either way... NO ONE is going to be hitting that trail any faster than 5MPH if that!

the rest of my wheeling, consists of campfire drinking! Elbe is the only place and on the BusyWild that i actually will have a Beer open while sitting behind the wheel.

I did not read all 49 pages so excuse me if this has been covered already. just go ahead and flame me (like you needed permission).

You know I have to say that I enjoy drinking responsibly. I don't drink and drive. But while I am wheeling and we do a night run (when we are camping and not going home that night) then I may drink a little while on the trial. I don't get hammered. But what the fastest I am going is maybe 5mph and we are doing easy trails nothing that takes all night to get through.

The problem with alcohol is that 90% of people don't know how to control it... alcohol is not a bad thing, it is an abused thing. I know half of the people on here will say that it causes all the problems. But think of the people causing problems when they drink, most of the time they would do it if they were sober. No one these days takes responsibility for thier actions they have to have something to blame it on and alcohol take the blame. It doesn't make you do anything you don't want to do (including the morning after trying to sneak out of a strange house), you still make the choice even if it is the wrong choice. No one holds a gun to your head.

End of Rant.
 
What's with this 5mph thing? It isn't the speed on the trails which kills people, it is the poor judgement, and the last time I looked, alcohol caused poor judgement. :eeek:

Agreed...........

It impairs alot of functioning needed motor skills...

but, it shouldn't be a nessasary evil when someone does have a beer and is offroad and is wheeling, again it's not something I say is right, nor am I ashamed or hiding the fact that I do have a beer when on the BusyWild.

I know it's a punishable offense and treated just the same as if your on the roadway in town, if caught with a open beer while on a trail. even if your a passenger with one in your hand!

i guess it comes down to each to his own, i wouldn't like to see it enforced or cops along trail sides, but I think we all do a great Job in keeping a eye on our friends, and knowing when is when... etc.

rule is - don't drink when offroading (.) but sometimes in the EXAMPLE i've used, it's not a right of way or excuse or what ever, but it's what I do, and knowing we are stuck or soon will be... or someone will be, makes it justifiable somehow for me. and I think I'am responsible enough on my own to know when is when or etc.

some don't though, and there the ones that might not have a reflex to quick thinking or just be too slow due to being buzzed / drunk. and get hurt, hurt someone, cause trouble, get into trouble.... etc....

everyone is different, as a group or bunch of more or less strangers out on the trails for the 1st time or last time, we should show control and tolerence towards others, and just wait until we get back to camp!
