With any firearm you buy from an FFL dealer, a Form 4473 will have to be filled out and they will have to call it into the National Instant Check System for a background check. Contrary to what most people believe, the 4473's do not go to the ATF. They are kept in the FFL dealer's records for a minimum 20 years in case the gun is used in a crime and the ATF needs to do a trace. The ATF does not have a copy of the forms due to the Fireams Owner's Protection Act of 1986 where there is a law against them keeping a database of these purchases. If you buy two or more handguns in a one week period, you will have to fill out a multiple handgun sale form. These are all federal laws, which are the minimum a state must follow. Some states have stricter laws to follow with handguns and "assault weapons" but thankfully Alabama is not one of them.

With private sales between individuals in the same state, there is no paperwork or background check to be perfomed. If the private sale is between two people in different states, the gun will have to be transfered to the buyer via a FFL dealer in the buyer's state.

im not sure if this is contradictory or not (only caught part of the converstion) but i was at dicks sporting goods (to look for rossi circuit judge) over the weekend and overheard the guy at the gun counter telling a customer something about " if convicted of a felony, domestic violence, or misdemeaner that they would come pay you a rediculous low price and take the gun", im not sure what type gun they were talking about and if it was the NICS or the ATF tht would come after the gun but it would suck to lose your gun because you had to give somebody an attitude adjustment or ippl :drinkers: or some other minor discrepancy

the main reason i was wandering about the purchase of fiearms from a dealer is that there is a few guns ive been wanting (ruger 10/22 and ruger mini 14 or maybe a mini 30, also a 30-30 lever action) and all of my firearms (except one handgun that i purchased from a buddy) were handed down from my parents and grandparents so the gov dont have a clue what i have or dont have and i would just as soon to keep it that way in case we ever get some dickhead in office that wants to take all our guns away

It would be neither ATF or NICS. Unless you get convicted by a Federal agency, it would be the local law enforcement agency that arrested you for the crime that would seize them. Supposedly, if something like that happens, you will receive a "surrender or sell" order and will be required to hand them over or sell them to a dealer. They will not know exactly what guns you have so they go about it that way firstand give you the option. This excludes raids with a warrant in which they will seize them on the spot.

Bet they would've had a change in attitude if he was firing my little rifle at them.
