Has anyone heard anything about it?
I was over on the Zukikrawler site and some of the guys I believe are on this site also were their. Did not sound good though. It basically sounded like they had been on this trail about one year ago. Not signed, prospector came out with a shot guy and one of the passengers may loose his arm.
I wish the best for the guy that got shot.
Been through something similar as a teen, lost a friend not a good time.

Explain this last quote, are you saying the shooters are from WA.

im sorry but the olg guy would never have even gotten the chance to get nearly that far befoer i would have layed him out. if you even show signs of pointing a gun at me or any of my friends i will give you one warning as i draw my pistol and my second warning is the wounding shot.. if i have to fire a second you wont be breathing.


that is total bull****. the old man in the woods needs to have the breath taken away from him for that. he is only a waste of life at this point.:rolleyes:

No the wheelers. I know nothing about the shooter. I believe one or more of the wheelers lives in WA (south end) and have been memebers of this site.
 
Wow just read the story...granted it was only one side of it but that makes for some interesting conjecture about how a person would respond to a situation like that. Obviously they scewed up and were on private property and the guy had every right to have his shotgun but to shoot without the threat of bodily harm is not good.

As soon as you see the gun would you have drawn on him? Especially since you are on his property?
 
Too many variables...

Private property...?

Shooting a guy in the back...?

Trespassing...?

Maybe the guy is paranoid...to him you were all a threat?

Does Oregon have different state laws for the use of deadly force than Washington?

It's not the responsability of the land owner to sign & fence his property to keep folks out, it's the responsability of the public to know what they are doing and where they are doing it is legit.

Let's say you are out wheeling and stumble onto private property on accident. (IT's happened to me before up in the RimRock area)

Some crazy farmer comes out and starts shooting at you because you are accidentally on his land, but he doesn't think so.

You return fire and injure/kill the farmer.

Who's in the right?

I though about shooting the engine in my buggy saturday night at reiter but it was too late it already died:booo:

CALM DOWN i'M KIDDING....CRAZY FAWKERS KILL PEOPLE. Me, If I was up in the middle of nowhere I would have instantly done what Mr. shotgun told me to do, get the fawk off his property. Even if I thought he was wrong.
 
I can't see how someone won't get charged with something. Either Trespassing or assault, something.

I think in order to go for attempted Murder you have to show premeditation.

if a gun is pulled on me or around me, i will give one warning, and then draw mine and you get a warning no-kill shot and if you are still going for your gun or still a threat you will be taken out.

if u pull ur gun u best mean to use it. there are no warning shots. shoot to kill, or dont pull.

One man is in jail on assault and the other is in the hospital--you can draw your own conclusion from that...
 
Maybe Oregon is different, but a claim is not private property. You own the right to all the minerals on that location, but you cannot keep people from being there. I know of a couple claims that well-traveled trails and popular fishing/horseback-riding/camping spots are on. You cannot harm somebody for "trespassing" on your claim. I would at least understand a little bit if they were dredging his land... ?

Until you have been shot at by someone who whole intention is to kill you, you won't know how you will react. You can only hope that your training will be good enough that you react appropriately. Unfortunately you can't learn that at the instant the gun is pointed at you. It must be instinctual by that time.

If the person opposite you is well trained, and you will have no way of knowing how well trained the other person is, then the whole incident will be over before you have a chance to react.
