I do want to state again that I don't make it a habit of wheeling under the influence. I'm fine that people keep referring to me because I started the thread and have played devil's advocate throughout...

Thank you to everyone who has responded because I feel there is a lot of varying opinions and values in this thread.

I agree with NotMatt, however I don't carry beer in my rig.

If I was at an area that I was used to, and I had a beer or two with dinner, then we chose to go on a nite run on a farmilliar trail, sure. But no beer in the rig on the trail. Unless you are a passenger, then beer away.

I don't drink while wheeling. I get plowed, then wheel. :corn:

Search DUI or DWI it comes up the same. .08 it is. There are provisions for under .08 as "evidence" of being under the influence. The way I understand it is under .08 alcohol won't stick by itself but combined with other drugs it still may apply.
84toyota4x4- I see your a MP. You do realize this is not about the UCMJ and what the military police can convict on are different for us civilians?

As far as the topic I don't drink much and if I do it's not when wheeling. I'm not too worried about being under the influence when wheeling but more about the trip home or back to camp from the trail. As far as the trail being a road..not very often. It could easily be argued that the trail is not a road and we don't drive motor vehicles on the trail (that is unless were "hard core").:;

They're the SAME THING. They call it a DUI now, vs a DWI due to the wording of term. "Driving under the influence" sounds less "drunk" then "Driving while intoxicated".

Trust me. I've been on the recieving end. Not bragging, just setting the record straight. I hate internet know it alls.
 
Drinking and wheeling are the reason that I wheel with the group that I typically wheel with, THEY DON'T DRINK AND WHEEL! There are a couple exceptions but I know alot of people that start with "oh its just a couple, I'm just having fun" and turn into their junk on its lid and me the sober one having to rescue their stupid ass. I really, really prefer my wheeling group being dry.
 
Ok Nuzzy, I didn't take the 2½ hours to read all these replies, but I'm in the NO crowd. I know alot of people who do do it. And that is their buisness, I personally don't take any with me. If I break or have a "****ting my pants" moment and would like one after I usually have plenty of volunteers with offers. But when running trails like Rimrock where there is no margin for error I always liked to be on my game to save my equipment and most of all my family who was usually with me. Our trails down here are not a life threatening as RR and there is definately more time to hang out and BS on the trail when it takes toy 6-8 hours to go less then a mile. But to me it makes the first one back at camp, while firin up the BBQ to cook up some big ass steaks or burgers, taste that much better.....:Good:

Then it must suck to hate yourself:booo: DWI only covers alcohol related issues. DUI was created to handle drug issues as well since there are to many smart lawyers out there that found a loophole
 
A man's gotta know his limitations, I see no problem having a Heiniken when ya get to when ya get to the top....not a six pak!!!! Ya still have to go back down, so I don't mean open container.. but at this point you've had one beer... that affects me about as much as a cup of hot chocolate, by the way, I have maybe a beer every couple weeks! if you were thinking something else!

drinking and driving is drinking and driving wheter on a trail or road IMHO.


its all fun and games till someone ****s in the sink...then its a DUI and cost $1700 minimum to get yourself out of trouble and on parole....

i personally dont drink and drive ever. i dont mind people who have a beer and wheel. big difference from a beer to a few beers and wheel.

A cousin of mine (at least the one time I wheeled with him) drank several beers and lit up a bud or two much to my dislike.

He threw all the empty beer bottles off to the side of the trail.

I got the feeling that this might be normal out at Reiter, but go ahead and tell me otherwise.

Personally, I vote "No" in both cases unless your on your own property in which case it is none of my business.
 
I was on jury duty a few weeks ago. A woman was charged with being "In control of a vehicle while under the influence of alchohol".
Here are the facts of the case:

1) She was sitting in the drivers seat of her car while parked.
2) The keys were not in the ignition.
3) She blew a .08 on the breath test thingy
4) She was convicted, received a large fine, but avoided jail time.

According to the law, you only have to be in control (behind the wheel) while under the influence to be convicted.

I think she got pegged by a asshat cop cause he saw her come out of the club and get into the car. I also think the cop profiled her because of her race.
Nonetheless, she got pegged and wasn't even driving :stirpot:

Wow, that's a large pile o' steaming crap there :haha: :haha: I'm 41, so I have some experience with intoxication. You may THINK you're compensating, but you aren't. That's the whole issue here. :rolleyes:

Just because you can't doesn't mean others can't.

Part of "compensation" is knowing how much you can drink for any given situation, and refraining from certain activities when you've had too much to do them safely. If you aren't capable of such judgement, then I guess the government is in fact saving you from yourself.
