Why non-motorized wins and we get nothing. Hint: it ain't their fault.

The two major issues that have been levvyed by DNR and private land owners is Liability and resource abuse.

By entering into a stewardship agreement with a landowner, their liability would be effectively nothing.

Sounds good but I don't agree. A contract like this may help with the resources damage but does very little for liability and may even make the landowner more liable then they were with no contract.

Negative. I talked with Blair, the Mayor, Kelli Linville, and Bellingham's CFO. The stewardship agreement requires them to carry $1million insurance and have the land owner listed on it.

It also uses the recreational immunity clause to say that the land is free from liability because they don't charge to use it.

It also states that WHIMPS is responsible for making sure signage and any 'known latent' conditions on the mountain are clearly posted.

Lastly it states that with insurance and the potential of a suit, WHIMPS will in good faith will come to the defense of the landowner.

Remember, this is a legal document, thats been in use for 3 years. It works. It also is covering a sport that most likely is much more dangerous than ours. They have WEEKLY calls to the hospital from Galbraith.

But like polygon had issues getting the city to be serious about changing ownership, in order to get the county and/or DNR to be serious about doing an agreement like this, I need more support. Thats the difference between the mtn bikers and us. When someone suggested this, 50 people signed up and called Mark and made WHIMPS happen. When I suggested this I get some thumbs up and then a diatribe about how it probably wouldn't work.

I can't do it alone. I can (and have) started .. but it will take much more than myself to make this happen.

Can't say specifically where its at, but it is in whatcom and/or skagit county.

The plan is to introduce a stewardship agreement to the county, the ORV groups (4x4, atv, motorcycle), and then the land owner. Working on re-writing the WHIMPS one, since its pretty good.. need some better support for the trails we want to build. Can't use the Reiter standard because its too costly (and frankly not necessary)

They can have it in place forever and not know if it will work until the day comes where someone suits......Now keep in mind this only applies to private land. Gov land has set standards which aren't much different.

Own Risk. WHIMPS acknowledges and agrees that all recreational activities undertaken by it on Galbraith Mountain are undertaken at its own risk, and that Polygon 05 shall have no liability whatsoever for any injuries to persons or property occurring due to such activities. WHIMPS shall cooperate in good faith in the defense of any action brought by any person making a claim against Polygon 05 for that person

All Trails constructed, installed or maintained by WHIMPS and/or its members shall comply with the "Construction Guidelines" published by the International Mountain Biking Association (the "IMBA") as set forth in its manual entitled "Trail Solutions," or any future similar IMBA publication intended to replace the same (the "Trail Standards"). WHIMPS shall, at its sole cost and expense, conspicuously post and maintain warning signs advising users of known dangerous artificial latent conditions on the Trails on Galbraith Mountain as provided for in the Act including, but not limited to, at the entrance points to the Galbraith Mountain and on WHIMPS' website, www.whimpsmtb.com.
 
Mtn biker = Liberal = support in Metro public and Legislature and less resistance from greenies.


Wheeler = Conservative or outcast liberal = **** on by all corners.



I mtn bike 3-5 days a week.

I have wheeled my own rig twice this year. And it was my chevy.



I hang with both user groups, and i say that yes, mtn bikers for the most part have their **** together. Organized Hive mind.

Wheelers are wheelers. there are ALL kinds...It's alot more than 1% in the 4 wheelin crowd. ALOT of shitbags, and sadly they seem to draw an incredible amount of attention.
